Terms of Use

These Terms of Use ("Terms") govern your access to and use of the WIMS platform (accessible at wims.pro), operated by FocusQ, Sofitel Complex, Office 86, 1st Floor, Msheireb, Doha, Qatar.

By creating an account or using WIMS, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Definitions

• "Platform" means the WIMS web application, mobile applications, APIs, and all related services.
• "Tenant" means an organization that subscribes to and uses the Platform.
• "User" means any individual who accesses the Platform, including Tenant Admins, Managers, and Employees.
• "Content" means any data, text, files, images, or other materials uploaded or generated through the Platform.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person or organization may not maintain more than one free-tier account.

3. Service Description

WIMS is a multi-tenant Software-as-a-Service (SaaS) platform that provides workforce attendance tracking and visitor management capabilities. The Platform includes:

• Employee attendance tracking (biometric, GPS, mobile app, CCTV integration)
• Visitor management and security check-in/check-out
• Shift scheduling and roster management
• Reporting and analytics dashboards
• Hardware device integration
• Mobile applications for iOS and Android

4. Subscription & Billing

• Free plans are available with limited features as described on our pricing page.
• Paid subscriptions are billed on a monthly or annual basis, depending on the plan selected.
• Prices are subject to change with 30 days' notice.
• Refunds are provided only in accordance with our refund policy or as required by applicable law.
• Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law
• Upload malicious code, viruses, or any harmful software
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform to collect data in a manner that violates privacy laws
• Resell, sublicense, or redistribute access to the Platform without authorization
• Use automated tools to scrape or extract data from the Platform
• Interfere with or disrupt the integrity or performance of the Platform

6. Data Ownership & Intellectual Property

6.1 Your Data

You retain ownership of all data you upload to the Platform ("Your Data"). You grant us a limited license to process, store, and display Your Data solely to provide the services.

6.2 Our Intellectual Property

The Platform, including its design, code, features, logos, and documentation, is owned by FocusQ and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Platform.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

• We aim to maintain 99.9% uptime but do not guarantee uninterrupted access.
• We may perform scheduled maintenance with reasonable advance notice.
• We are not liable for downtime caused by factors beyond our reasonable control (force majeure).

9. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• FocusQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform.
• Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FocusQ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or your violation of these Terms.

11. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the Platform ceases immediately.
• We will retain your data for 30 days after termination, after which it will be permanently deleted unless otherwise required by law.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Qatar. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Doha, Qatar.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
